These Terms of Business of Suppliers of Tours and Users (hereinafter referred to as “Terms”) shall be applicable to the contract entered into between a user of the AdventureRepubliq Booking Platform available at www.adventurerepubliq.com and the supplier, when, such user makes a booking of a tour, experience, ticket, adventure, or related product and or service (Here in after referred to as the “Services”, “Products” or “Product and Services”) offered and owned by such supplier, having made his Products available at www.AdventureRepubliq.com. Such users and such supplier will in these Terms also be referred to as parties to the contract.

2. Acceptance of bookings

Only people who are authorized and can act in the name of the supplier can accept bookings by a user on www.adventurerepubliq.com

If a supplier accepts a booking of a Product but subsequently finds out that the information provided by such user when making a booking was intentionally incorrect in order to obtain such booking or for any other malafide reason, the supplier shall have the right to cancel such booking. For such cases, the price already paid by the user cannot be refunded if the supplier had made arrangements. In such cases, the user shall himself/herself be liable for their actions.

3.User responsibilities

Immediately after making payment the contract between a user and the supplier of such Product will be concluded, provided that the supplier either immediately or within 48 hours accepts such booking. By making payment users are thus making a binding offer which will be valid for at least 48 hours after payment. In case the supplier does not accept a user’s offer within 48 hours, the user will be notified via e-mail. After accepting a booking the supplier will provide the agreed services on his own behalf and at his own responsibility.

Users are responsible for timely arrival at the Product meeting and starting point at the time prescribed. In case the user for some reason is delayed the supplier shall make best efforts to accommodate such users. However, if such a delay is significant and impedes the execution of the Product for other users, the supplier shall be at full liberty to cancel the booking. In case of such like cancellations, no money will be refunded to the user.

A user shall be solely responsible for full compliance of the conditions of participation of the Product. The supplier can exclude you from the participation of a booked Product in the event that you are not in full compliance of the conditions of participation. For these cases, no refund can be made to participants/users that are not in compliance, provided further that the supplier must have listed all such requirements of participation in the Product and services description page, at the time of booking.

4. Parties to the Contract.

The AdventureRepubliq acts only as a marketplace and aims to provide a smooth booking experience for the user as well as the supplier and charges a commission for the same payable at the time of making payments and recoverable from the supplier. AdventureRepubliq is in no way directly involved in the selling of any products or services to its users, the supplier provides the agreed Product under his own account. Therefore, it shall be the sole responsibility of the supplier to deliver the agreed product to the user. AdventureRepubliq is not a party to the contract between user as a customer and the supplier of the Product and therefore has no responsibility or liability to the user or the supplier in respect of the terms of that contract whether directly or indirectly.

5. Payment

Upon requesting to make a booking of a Product with a supplier the credit card of the user making the booking will be charged. However, if the supplier does not accept the booking within 48 hours the charged amount will be credited back to the same source account from which it was debited.

When making a booking, AdventureRepubliq charges the full payment upfront for some Products and for other Products AdventureRepubliq charges a nominal deposit after which the remaining payment is required to be made to the supplier directly upon arrival, or to AdventureRepubliq before the Products start date.

If a user fails to pay for the booked Product or service or if the credit card authorisation is revoked, in such like events the claim of the user to receive the Product is deemed null and void and the. Such instance shall be regarded as a cancellation and the cancellation policy stated below shall govern the same.

After payment, the user is responsible for showing up at the specified start date and time. In case the user does not show up, this shall be regarded as a no-show, and full payment shall still be made to the supplier. Cancellation is not possible after the start date and time.

6. Disclaimer on the right to cancel

After requesting to book a Product should the applicable law between the contracting parties grant the user waives his right of cancellation in his/her favour, the users waive such right, to the extent permitted by law.

7. Cancellation policy

7.1 Cancellation by the customer

If a user cancels the Product the cancellation policy stated in the booking confirmation received shall be final and binding. The users are therefore requested to always read the booking confirmation carefully.

Traveller Cancellations and Refunds If, as a Traveller, you cancel your requested booking before the requested booking is confirmed by an Operator, AdventureRepubliq will cancel any pre-authorization to your credit card and/or refund any nominal amounts charged to your credit card in connection with the requested booking within a commercially reasonable time. You agree to pay AdventureRepubliq for the Total Cost for any booking requested in connection with your AdventureRepubliq Account if such requested bookings are confirmed by the applicable Operator. Once your booking is confirmed by the applicable Operator, the total cost of your Tour is subject to the cancellation and payment terms of the Operator. This cancellation must be done via your booking conversation page. However if you are advised that your booking is an ‘on request’ basis, the above rules do not apply. This is because when a tour is ‘on request’ the Operator usually has to have their Operations Team submit special requests to their suppliers. So if the request comes back approved you will be charged for the full amount. However, if the Operator cannot confirm your request you will receive a full refund.

In case the supplier fails to specify any cancellation policy in the booking confirmation received the following cancellation policy shall apply:

  • For Products with a duration of 1 day or less: The user is entitled to cancel his booked Product up to 24 hours before the start of the Product, in which case a full refund will be made.
  • For Products with a duration of 1 day or less: If the user cancels a booked Product less than 24 hours before the Product start, or if the user does not attend the Product whatever the reason may be, the user shall still pay the full price and no refund will be given to the user.
  • For Products with a duration of more than 1 day: If the user provides a notice of cancellation more than 30 days prior to the Product start date, the Deposit paid will be forfeited. If the user provides a notice of cancellation between 30-15 days prior to the Product start date, 50% of the total Product costs will be forfeited. If the user provides a notice of cancellation less than 15 days prior to the Product start date 100% of the Product costs will be forfeited.

For communication of a cancellation notice, please inform AdventureRepubliq in writing via [email protected]. Only notices communicated in the manner advised shall be deemed valid unless AdventureRepubliq accepts another form of notice of cancellation.

Any refund required to be made to the user will be made within 18 working days to the mode of payment used for making a booking.

If a payment was not made for the booked Product or if the credit card was revoked, this shall be regarded as a booking cancellation. In such a case, AdventureRepubliq reserves a claim for further damages if any.

7.2 Cancellation by the Operator

Operator Cancellations and Refunds If an Operator cancels a confirmed booking made via the Services, a refund of only the Tour Cost for such booking will be made to the applicable Traveller within a commercially reasonable time of the cancellation and (ii) the Traveller may receive an email or other communication from AdventureRepubliq containing alternative Listings and other related information. If an Operator cancelled a confirmed booking and you, as a Traveller, have not received an email or other communication from AdventureRepubliq, please contact AdventureRepubliq at [email protected].

Should such circumstances arise which are beyond the control of the supplier and that they hinder the supplier from carrying out the booked Product in safe manners, he shall have the right to cancel the Product. In such cases, a full refund shall be made to the users and the supplier shall not be compensated for any damages so incurred.

In case a supplier has already begun to execute a booked Product but forced to stop the execution of the Product before its end due to circumstances beyond his control and which stop him from carrying out safely the Product in full, the supplier shall be entitled to cancel the Product and also be entitled to a compensation on a pro-rata basis.

The supplier shall also have a right to exclude a user from participating in the booked Product if a user does not meet the participation requirements stated at the Product booking page or if the user otherwise compromises the safety of himself or others, or otherwise interferes execution of the Product or service. For such cases, a user will not receive any refund for the booked Product or service.

For communication of a cancellation notice, please always use the method specified in either the booking confirmation or on www.AdventureRepubliq.com. Only notices communicated in the manner prescribed shall be deemed valid.

Cancellation in the Event of Inclement Weather

Certain Tours may be weather-dependent. Notwithstanding the foregoing, in the event of inclement weather, the Operator has the discretion as to whether the weather conditions will prevent the Group Tour from taking place. As an Operator, if you need to cancel a Group Tour for reasons of inclement weather, you must contact the Traveller and AdventureRepubliq (at [email protected]) as early as possible. Subject to the Traveller’s consent, the Operator and the Traveller may choose to reschedule the Tour for another date.

If the Tour cannot be rescheduled, as a Traveller, please contact AdventureRepubliq so we may assist in finding a replacement, non-weather-dependent Tour. For clarity, in the event the alternative Tour is of a higher price than the former, you may be responsible for any difference in price. In the event the alternative Tour is of a lower price, you may be entitled to a partial refund for the difference.

As a Traveller, if you have contacted AdventureRepubliq as provided above and AdventureRepubliq is unable to find you a replacement Tour, AdventureRepubliq may refund the deposit for such booking to the applicable Traveller within a commercially reasonable time of the cancellation.

8.0 Product changes

The supplier is allowed to make minor changes to the content of the Product if necessitated by unforeseeable or unpreventable circumstances keeping in mind the safety of the users. However, any major changes which are bound to change the user experience substantially shall be treated as a cancellation by the supplier and shall be governed by clause 7.2 of these terms.

9.0 Insurance for the booked Products

Unless otherwise stated insurance is not included in the booked Products. It shall be a user’s own responsibility to take out the necessary insurance to carry out the Product in safe manners.

10. Other conditions

Other conditions for the Product can be found on the Product page of the supplier. Product conditions specified therein shall be applicable.

11. Time and time zone

For time and date, the time zone of the supplier shall be applicable.

12. Liability of the supplier

The supplier shall be liable according to the applicable law, and according to the Cooperation Agreement signed with AdventureRepubliq.

13. Changes of this Agreement

These Terms can be changed by AdventureRepubliq at any given point and time with immediate effect. The Terms governing a booking shall be the applicable Terms at the time of booking.

14. The legal relationship between the parties to the contract

The legal relationship governing the parties to the contract shall be governed in all cases according to the applicable laws for the time being in force.
